For Sale By Owner | Who You Have to Negotiate With

When you think about selling your home or condominium on your own, you really have many hats to wear. And during the process, you’ve got many people you will have to deal with. Yourself.

The Buyer

If you are not offering a commission to a Buyer’s agent, you may be talking directly to your buyer. Be careful. You could tip your hat in the negotiation process if you say something you shouldn’t.

The Buyer’s Agent

But you are paying a Buyer’s agent if they bring you a buyer. Now, you have no one to act on your behalf in the negotiations…but the Buyer does. Their agent. If you’ve sold a home or two, this rodeo may not be a problem for you. And then again….

The Buyer’s Attorney

In Georgia, the closing attorney represents the lender, if there is a mortgage involved in the purchase. So, rather than your agent calling to check on the progress of the title search, and all, you will be.

The Home Inspection Company

You should not be present for the home inspection. Maybe you already know that? But, if you have any questions about the report, you’ll be directing the to the Buyer’s Agent (who represents who….?) or you will be calling the inspector yourself with any questions you have about the report.

If the Buyer is asking about your termite bond, or elects to have a termite inspection, and issues arise, you will be the negotiator.

The Buyer’s Lender

Want to know if all the documents needed by the lender have been submitted by the Buyer? How is the loan progressing? Appraisal in? You’ll be trying to call the Buyer’s lender, or calling the Buyer’s agent, and hope they are responsive to your calls and questions.

The Appraiser

Times have changed, and the lender cannot contact the appraiser directly. They must go through an appraisal management company. You, on the other hand, can pick up the phone and scream if you have an appraisal issue!

The Title Company

In Georgia, this is also the Closing Attorney, who requests the title search on behalf of the lender.

The Town or Municipality

Perhaps the Buyer (at the recommendation of the Buyer’s agent) had a survey done on the property if it’s a single family home. And there is an issue on the survey. You’ll be contacting the city if there is an issue with say a property line, or utility easement, or other surprise you may not have known about.

The Buyer’s Buyer

Does the Buyer of YOUR home need to sell their home? How do you know how that side of the equation is going? You’ll be asking the Buyer’s agent to find out for you….and hope you are getting a straight answer that will not later delay our closing.

Your Bank

Besides the possibility of a short sale, if you need payoff information, you will need to contact your bank and get this information. This would be the same if you had your own agent, but if it were a short sale, most likely your listing agent would have had you hire an attorney to negotiate your short sale terms.

There is a lot that goes on when you sell your home. And it can be a stressful time, managing all the parts. And to do it by yourself……whew!!

WHAT is an Unconventional Borrower you ask? Well, believe it or not, there are many of us out there!

Some of the home buyers that fall in this description might be:

  • Self- employed or independent contractors (such as real estate agents of if you are a 1099 employee.
  • Small business owners
  • Individuals with irregular income (contract consultant)
  • Immigrants with limited credit and job history

If you might fit in one of these categories, and thought you could NEVER buy, then we have found a lender that can help you!!

Now, I’ll first off say, that you need to have some serious “skin in the game” in the form of 40% for a down payment. Yeah, that’s alot. But, it’s better than 100% of the purchase price, right?

The Bridge to Home Loan Program with East West Bank is an opportunity to help those that might not otherwise be able to get a loan to purchase a home or condominium. Imagine if you were a couple, and one of you was not a U.S. Citizen, but you wanted to purchase a home. And your significant other (from the other country) has good income or assets in this other country. Well, a traditional mortgage will not consider anything from the other country….so your ability to purchase would be based solely on YOUR income and debt!

So now, not only can we help you FIND the home you are looking for, we have a lender to help you with the financing! Keep in mind, this program will take longer to clear the underwriting process, and if a condominium, the community will have to be approved by the lender. (A traditional lender will have most likely done a loan in that condo building and already be familiar with it.) What this means, is we will have to work with the Seller and Seller’s agent to get a longer escrow (Under Contract) period as well as a longer financing contingency. All because of the unique nature of you, the Buyer, we need to have more time to finish the process.

Homes for Sale in Huntley Hills chamblee August 16, 2015Most of your single family neighborhoods, such as Huntley Hills, are just far enough from the Chamblee MARTA station, that you will need to drive to the station. But this short drive, and then a train ride to Midtown or Downtown will give you just enough time to catch up on the news or the latest film project that might be happening nearby.

However, there are several condominium options close to the station, including Lofts at 5300, Eco Lofts and Heritage Lofts, all within walking distance of the station. New apartment developments are under way in the area, including The Olmstead and Parkview on Peachtree, which will provide rental opportunities within a walking distance of the station.

Midtown Atlanta Condos For Sale Mayfair Renaissance Mayfair Tower

One of the great parts of Midtown Atlanta, is what I like to call our “backyard” and that is Piedmont Park. There are numerous festivals throughout the year (not always to the liking of the nearby residents) but there is also great places to walk, run, bike, a dog park, the Piedmont Park Pool…the list can keep going. And it can be even more enjoyable when you live in a condo building that is really close to the park. Enter Mayfair Renaissance and Mayfair Tower.

Mayfair Renaissance Tower Midtown AtlantaIn all fairness, I really should write about these two buildings separately, as they are different with totally separate HOA’s. But for the sake of telling you about this community, I will cover both of them here.

Mayfair Tower was built first, in the early 1990’s. The Mayfair Renaissance came some ten years later, hence the two different HOA’s. While the buildings have mostly the same amenities, there ARE differences. One common feature is the signature rooftop cupolas on both buildings, that are easily recognizable from many places in Midtown and beyond.

There is a small club room, but also a library room with books and a quiet place to sit and read, or perhaps conduct a client meeting. There is also a fitness center. Two amenities Mayfair Tower does not have is a swimming pool or a theater room. I am always telling clients to seriously consider the lack of a pool when buying a Midtown Atlanta condo. You may not think you will use a pool, until it is one of those 95 degree July days like we are having now…and then you will wish your building had a pool.

Homes in Mayfair Tower consist of studio, one bedroom, one bedroom plus a den, and two bedroom homes. Since they were built in the early 1990’s, original homes will be missing the construction norm of today consisting of granite and stainless appliances. Over time, many owners have remodeled and upgraded their homes, so it’s something you will want to watch for if you are looking at this building. You may have a chance to do your own thing, or enjoy what someone else has already done.  Parking is provided in an underground garage. Another word of caution…watch for the number of parking spaces assigned to your home. Sometimes, a 2 bedroom will only have one space versus the customary two spaces.

Midtown Atlanta Condos For SaleHeading across the central courtyard driveway, we come to the big sister, Mayfair Renaissance. Here, you will find a larger lobby along with a 24-hour Concierge. The Mayfair Renaissance does have controlled access elevators along with the lobby access. Just off the left of the lobby is the club room, which has been renovated and is much larger. Also on this side of the main floor, you will find access to the POOL as well as the extra large fitness center! On the opposite side of the lobby, you will find another great library room along with a theater room.

Mayfair Renaissance Tower Looking UPThe Mayfair Renaissance recently went through a common hallways renovation that has greatly improved the look and feel of the building. Again, based on this building being built in the 1990’s, you will still find homes that have not been renovated in terms of bathrooms and kitchens, and then again, I have seen some great renovations.

Located on 14th Street, if you are searching on-line for listings in theses buildings, you can tell the difference by the address. Mayfair Tower is 199 14th Street, and Mayfair Renaissance is 195 14th Street. The buildings have a great location for convenience to Piedmont Park, but are just across the street from Colony Square and the W Midtown Hotel. Colony Square was recently purchased by North American Properties (known for the repositioning of Atlantic Station and Avalon in Alpharetta) and have big plans to bring this sleeping giant back to life. Exciting news.

I always like to talk Atlanta Transit News! No doubt, Atlanta is a MAJOR metropolitan area with a MINOR transit system. I don’t say this to scare anyone if you are looking to move to Atlanta, but you just may want to consider where you live and where you work and what your potential commute to and from work could be!

Case in point….an article I saw on Brookhaven Patch, talks about the future growth of the Atlanta area, and specifically mentions Forsyth County, which is North of Atlanta, accessible by GA400 or GA 141 (Peachtree Parkway). Cities like Johns Creek, which IS in Forsyth County (and borders North Fulton County) passed a resolution that they DON’T WANT MARTA coming to their city. Seriously? Yet this very article talks about Forsyth County being the fastest growing county in ALL of Georgia in 2014-2015! And it projects that the area will see a 58% increase in population growth between now and 2030!!!!

I’m here to tell you…all them cars are NOT going to fit on an already clogged GA400 coming in or going out during commute times!

But I subscribe to the Citizens for Progressive Transit newsletter, which always has good information about transit and what may be happening in our city.

The City of Atlanta will be looking to get some new transit projects going with the legislation approved by the Georgia General Assembly this past Spring. The big challenge Atlanta is having with transit (well besides the fact that we can’t seem to get people to VOTE FOR IT….) is that to run rail lines now, will involve displacing homes and businesses. It’s a shame the routes were not laid out years ago and protected from development, but that did not happen. So now, many options are directed towards bus rapid transit as a way to get people around.

Maybe one day.

Buyer Beware You May be RecordedWhen showing a home or condo to a prospective Buyer, I never want the Seller to be in the home. I too, understand if you have expensive art work and such, that you may want your listing agent there during a showing. (That too, can  be a challenge) If that is the case, I always caution my Buyers not to get excited, or show much emotion about the home, as it truly CAN affect our negotiation position later if we make an offer on the home.

But, do you really know if you are all alone in the home? Hmmm….with the technology at hand and available today, that one book on the bookshelf could infact be recording our conversation. And most likely, perfectly legal. Afterall, you are in THEIR home!

So, if you are inclined to trash someone’s choice of decor, or express “this is it…we HAVE to have this house” while touring a home or condo, it just might all be on a recording!
