CC&R Conditions Covenants and Restrictions What Are They?

CC&R Conditions Covenants and RestrictionsIf you are buying an Intown Atlanta condominium, then you will certainly want to know what the CC&R (Conditions, Covenants and Restrictions) are in the community where you are buying.

CC&R’s are most often defined as stipulations  and constraints recorded in the Condominium Declaration that restrict the what you, the buyer can and cannot do within the building and even inside your own home. There may be penalties for failure to comply, or these can be set and adjusted by the Home Owners Association (HOA) Board of Directors.  This document is used primarily to define the rules in the building, and while they can be quite restrictive, that really ARE for your protection.

What are some of the items or rules in a CC&R? As I thumb through a copy of the condominium documents (you’ll hear these called condo docs for short) here are some of the areas covered:

  • Alterations to the Interior of a Component — meaning you may not make substantial renovations to the inside of your home without first gaining approval of the Architectural Review Board(ARB). This is NOT a bad thing….but is meant to protect you and/or your neighbors from doing something that could cause harm or damage to another home. Keep in mind, the walls in condos are filled with wiring and pipes that might service adjoining homes. Cutting into sheet rock could possibly damage these if you don’t know where they are. The ARB has the engineering plans and can make sure none of your planned renovations could cause problems.
  • Pets — The HOA can restrict the type, size and number of pets that a resident may have in their home.
  • Restriction of Use of your Unit — this usually is to control your neighbor from running a business out of their condominium which might affect your quiet enjoyment of your home.  An example might be a personal trainer or massage therapist that has clients coming to see them on a regular basis.
  • Balconies, Terraces and Patios — these regulations are for a number of reasons. First off, when standing on a balcony, you often can see multiple other balconies at any time. Do you want to look at a bunch of pots full of dead plants, or bikes, or other stuff? Most likely not, hence the rules. Also of concern in a high rise is the wind factor. When you are 20 or 30 stories up in the air, the wind is a whole different animal. Plastic furniture can easily be lifted right off a balcony…and by the time it reaches the ground, it’s a lethal weapon that could seriously injure someone. Hence, rules about the kinds of furniture you can have.But, CC&R’s can also be an issue in single family neighborhoods. These communities can have rental restrictions such that you get a job transfer and think you can rent your house, but you can’t! They also have strict landscape guidelines as well as rules about things such as paint colors, garage doors being left open, parking of trucks or other items, etc.

When making your Intown Atlanta home or condominium purchase, always make sure your real estate agent obtains a copy of this information during your due diligence period and you have ample time to review it and ask any questions. If you find restrictions you cannot live with, you can terminate your Purchase Agreement and look for another home. But when you close, you will sign documentation from your lender that you acknowledge there is a homeowners’ association and that you agree to abide by all rules.

Also in today’s market, it is wise to see financial statements to learn about the condition of the HOA and their financial stability. With numerous foreclosures in today’s market place, some HOA’s may have not allowed for this loss in revenue and could have reserve issues. This can also become a problem during your lenders’ review of the HOA.

Market Knowledge DOES Matter When Buying Real Estate

Midtown Atlanta Real EstateSo, you’re looking for that new home or condominium and you’ve made a smart decision in seeking the help of a professional, a real estate agent, to represent you and your interests. An important point you need to consider is…   Market knowledge DOES matter when buying real estate!

You’re thinking, what a silly statement. Isn’t that what real estate people do? Know the market and what is happening? Well, you are about 50% right with that statement. Let me explain why choosing the RIGHT real estate agent for your home or condominium purchase is so important.

First off, any real estate agent that says they can help you anywhere (we’ll use the Atlanta market place as an example) is probably not a totally correct statement either. Take Lake Lanier or Lake Allatoona. Both are in the Atlanta Area. Both areas are within driving distance for me. Have I ever SOLD or LISTED lake property? NO! Do I know anything about lake shore easements, sea walls, docks and such? NO! So, do you think I’m the right agent to represent you in the purchase or sale of lake front property. Well, I’ll be the first to tell you….NO! But I will find you an agent that works in the area that I know and that is familiar with these unique issues and refer you to them. Again that question,  Market knowledge DOES matter when buying real estate!

Buying Midtown Atlanta Condominiums is very much the same way. Let’s say you are standing on the balcony on the 10th floor of a building, and there is a vacant lot, or a 3 story building across the street. You ask your agent what is proposed for that vacant lot. Do they know? Hmmm. I probably would. Because Midtown Atlanta is my market and I make it my business to know what’s happening in my market. (As a disclaimer to that statement, you as a Buyer are equally responsible to do your own due diligence on any issues that may be of concern to you, such as the future impact on your view.)

Today, I received a strange call. It was from another agent in the Atlanta ara with one of the MAJOR brokerage firms. When I answered the phone, she asked me if this was the Sales Center for MidCity Lofts Condominiums. Ah….darhling….MidCity Lofts was built in 2002!!! Which means the Sales Center has probably been closed for about EIGHT YEARS! Really? Are you representing a Buyer? Do you KNOW the Midtown Atlanta Condominium market well enough to be looking for a sales center that was closed 8 years ago? Scare me!

The same consideration should be given if you are in the market to SELL your Midtown Atlanta Condominium or home. Just because your husband’s brother’s wife’s sister is a real estate agent does not mean they are your best choice to represent you in the marketing and sale of your home.  Do your research. Google the name of your building (or community). See who you find? Most likely if they are knowledgable and know your building, they will either have a page on their site about it that ranks in a Google Search (good marketing point) or they will have written blog posts about the neighborhood. More Parents Buying Apartments for Their Children

I’ve already worked with several parents of GATech students that have done this very thing! It’s an awesome way to make a real estate investment (especially with prices down where they are now) and either have an asset to sell in the future, or perhaps turn it into a weekend city getaway retreat after the kid(s) have left college.

Georgia Tech Student HousingReal estate brokers say that in the last year, they have seen more parents shopping for apartments for their grown children, hoping to take advantage of low mortgage rates and apartment prices that are still about 20 percent down from the market’s peak.

“I got a digital watch for graduation,” said Barry Silverman, an executive vice president of Halstead Property, “but I’ve worked with families where the children are getting an apartment.”

These congratulatory apartments are often studios or small one-bedrooms, but on occasion they are bigger-ticket items, he said, because “the parents see it as a long-term investment and a good place to park their money.”

In many cases, brokers say, the parents do not live in the New York area and view the apartment as a potential pied-à-terre for themselves when the child decides to move on. Some buy it as a straight-out gift, a gesture of profound affection sweetened by the current generous tax exclusion. Others buy it as an investment and retain ownership, and still others acquire it through a family trust for joint ownership.

Finding The Best Buys In Midtown Atlanta Real Estate

Finding the Best Buys in Today’s Midtown Atlanta Real Estate Market

Spire MidtownIt is still very much a Buyer’s market here in the Midtown Atlanta real estate market. What does that mean to a buyer? Well, it means you can get a good price on a Midtown Atlanta condo.  However, if you know what to look for, there are properties on which you can get a great price.

Here are three areas of the Midtown Atlanta Real Estate Market that generally offer the best prices:

 

  1. Homes that have been on the market for several weeks (or months!) – Have your real estate agent send you homes that have been on the market for several weeks or months. These property owners are generally more motivated to sell than the owners of newly listed homes. They’re more willing to negotiate for lower prices or even give you extras such as paying upfront HOA fees or paying a portion or all of your closing costs.
  2. Bank owned properties – Bank owned properties (also known as Real Estate Owned or REOs) are homes that go back to the mortgage company after an unsuccessful foreclosure auction. Like foreclosures, the savings can be well worth the extra time that it may take to get closed. Your Midtown Atlanta Real Estate agent can help you understand the pro’s and con’s with this type of purchase and guide you through the process.
  3. “As is” properties. A property listed “as is” means the seller is not willing, or possibly able, to fix anything and will not negotiate a price reduction based on needed repairs. However, if you’re willing to put some money and elbow grease into the property, this could be your opportunity to get more home, in a better location and at a price you can afford. Thankfully in the Midtown Atlanta Real Estate market, we find that many of the bank-owned or foreclosed properties are usually in good, if not GREAT condition. There may not be the need for any work, but the Seller is just letting you know that if you find any issues during your inspection, they won’t be paying for the repairs.

A word of caution to the Buyer of  a Midtown Atlanta Condo, especially foreclosures! Your competition (other Buyers) can see the values in some of the prices offered, and you may find yourself in a multiple-offer situation. Be prepared to sharpen your pencil on your offer, or even offer over the list price (provide it’s priced right and not OVER priced) if you really find a condo you want.

Real Estate Terms to Know in Georgia (Protect Yourself When Buying a Home)

Midtown Atlanta Real EstateIn my last post, we started to review the Consumer Protection Brochure that all Georgia real estate agents must provide to their Buyers. Protect Yourself When Buying a Home offers some practical information that while most agents should review this with you when buying Midtown Atlanta real estate, it may not always be the case.

In our last segment, we touched on the following topics:

  • Keeping copies of your signed documents
  • Having your home or condo professionally inspected prior to purchase
  • Inspect and Get to Know the neighborhood where you are going to live
  • Termite Inspections (when necessary)

Now, let’s look at the other points of information you should consider.

Thoroughly Investigate the Property

Here, you want to consider anything and everything that could effect the purchase of your home or condo. From mold, to water to a septic system if buying a single family home. If the home or condominium was built before 1978, you might want to test for lead-based paint. Eating paint chips can be a problem for children. It also can be a problem for adults should you do renovations at a later time that involve sanding or wood surfaces that were painted.

Other real estate terms and things to consider include school districts, flooding, property insurance costs, and any covenants that might restrict the use of the property. For example, in purchasing a condominium, most all of the Midtown Atlanta condominiums have limits on the number of homes that can be rented at any given time.

Survey of the Property

This would apply if you are purchasing a single family home, or vacant lot. You want to know where your property lines are. I sold a home a couple years ago, and the lot line for my Buyers’ house was right alongside the neighbors house, not in the middle of the space between the two houses. A good thing to know.

Undeveloped Property CAN be developed

Pretty plain and simple…but you want to know WHAT you can do with the property and what kind of services may or may not be available. If there are no city water and sewer lines, you will be drilling for a well and putting in a septic system, both which will have rules.

Owner's Title InsuranceBuy an Owner’s Title Insurance Policy

If there IS a real estate term in Georgia you need to know, and HAVE, it’s owner’s title insurance. This protects you against any pre-exisiting title problems, if they come up after closing. Imagine a condo building that has been built on several lots that were purchased, and assembled to create the space to build. Some long lost relative surfaces and lays claim to one of the lots. In steps your title insurance policy.

Real Estate Terms to Know In Georgia ( Protect Yourself When Buying A Home)

Spire Midtown Atlanta Condos For SaleOK, so Protect Yourself When Buying a Home is a pretty long Real Estate Term to Know in Georgia. Actually, it’s a Consumer Protection Brochure that has been produced by the Georgia Association of REALTORS. In the past, it was optional for REALTORS or real estate agents to provide this to their Buyers. As of the 2011 printing of the Purchase and Sale Agreement, it is now part of the actual real estate contract.

This important brochure should be given to you at the START of your home or condominium purchase process by your agent. At Thomas Ramon Realty, this brochure is included in our initial information package, and we review it  with you.

Consumer Protection Brochure Paragraph

It has 10 specific topics that it covers as they relate to a home or condominium purchase:

  • Read and keep a copy of any signed contract

FileFolderIt would seem pretty common sense, right, that you would keep such things? Well, when you sign the Purchase and Sale Agreement, you have created a legally binding contract with time lines and dates that must be followed. Plan to have a file or notebook where you can keep ALL the documents related to your sale.  In case you might lose them, you could also consider scanning them and having them on a computer, backed up to a service like Carbonite where they would be protected.

  • Have the home or condo inspected by a professional home inspector

Having this inspection performed helps you and I examine the condition of the home and determine if there are any repairs that may need to be performed by the Seller prior to your purchase.  While we never hope for major problems, this inspection can uncover issues that you may not want to deal with, now, or in the future.

  • Inspect the neighborhood where you plan to live

Atlanta and Downtown ConnectorYou should take time, both with your agent and by yourself to get to know the neighborhood where you are going to purchase your home. There are many factors to consider. In an urban environment like Midtown Atlanta, you might want to visit the area both during the day, and at night to determine if there are any noise issues from surrounding businesses or highways. What is the proximity to a major highway or transit station if you commute to work? Being a long distance from a major highway can add travel time to your commute. Where is shopping, dining, gas stations and other services you might need? If there is vacant land near the building you are looking to purchase in, are there any known plans for that land? A knowledgeable agent like me that works the Midtown market can help you determine these things. Also, you can contact local government planning officials that might have new information about potential plans for development.

  • Termite Inspection

While rarely a concern in condos, this is an important consideration if you are purchasing a single family home. Again, our contracts have changed from where this was a Seller responsibility to provide this information, to now the Buyer is responsible for conducting these inspections. Again, this should be done by a licensed pest control company. If you happen to be purchasing in a condo community that is older, and has ground floor units, then this would be a wise inspection to have.
